1. COMPANY & OWNERSHIP

Sevenfires AI LLC, located in Wisconsin, United States, is the parent company and owner of the VivaLingua mobile application and the website at vivalingua.app (collectively, the "Service"). References to "we," "us," or "our" in these Terms refer to Sevenfires AI LLC.

2. AGREEMENT TO TERMS

By accessing or using VivaLingua, you agree to be bound by these Terms and Conditions. If you do not agree, do not use the Service.

3. ELIGIBILITY

You must be at least 18 years of age to use this Service. By using VivaLingua, you represent and warrant that you meet this requirement.

4. ACCOUNT REGISTRATION

You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You agree to notify us immediately of any unauthorized use.

5. PLANS & PAYMENTS

VivaLingua is sold as prepaid minutes. There is no subscription and nothing renews automatically. You buy minute packs when you need them, in the sizes and at the prices shown on the in-app pricing screen, and minutes you have purchased do not expire.

Only the host of a video call or in-person session uses minutes — guests always join free, though every participant needs the VivaLingua app installed on their own phone.

We may also grant promotional minutes, such as the minutes given when you confirm your email address at sign-up or earn a referral reward. Promotional minutes are not purchased, carry no cash value, and expire 90 days after they are granted. Purchased minutes are used only after available promotional minutes.

Purchases are processed through Stripe, the Google Play Store, or the Apple App Store depending on how you buy, and are subject to that provider's terms. Amounts already paid are non-refundable except where required by law or by the store's own refund policy.

6. ACCEPTABLE USE POLICY

You agree not to use this Service for any illegal activity, harassment, fraud, or to transmit harmful or offensive content. Violations may result in immediate account termination without refund.

7. VOICE TRANSLATION & CONTENT

VivaLingua provides real-time AI voice translation. We do not guarantee 100% accuracy of translations. You are responsible for verifying important communications independently.

8. CALL & SESSION RECORDING CONSENT

You are responsible for obtaining consent from other participants before recording any call or in-person session in jurisdictions where such consent is required. You agree not to attempt to circumvent any security or privacy protections we may put in place.

9. PRIVACY & DATA

Your use of the Service is governed by our Privacy Policy, which is incorporated into these Terms by reference.

10. LIMITATION OF LIABILITY

Sevenfires AI LLC shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service. Our total liability shall not exceed the amount you paid in the past 12 months.

11. THIRD-PARTY SERVICES

The Service uses Stripe for payments, Daily.co for video calling and real-time speech-to-text transcription during video calls (via Deepgram), Deepgram for speech-to-text during in-person sessions, Google Cloud Translation to translate finalized text, Google Cloud Text-to-Speech to generate the spoken translation, and Resend for transactional email. Use of these services is subject to their respective terms and privacy policies.

12. DIAGNOSTIC AND PERFORMANCE DATA

We collect anonymous technical performance data, which you can turn off in Settings. We also collect a smaller set of diagnostic and crash records that ARE linked to your account, so that a specific failure can be investigated and so that those records are deleted when you delete your account. Neither includes what you said or the text of a translation. Both are described in the Privacy Policy.

13. INTELLECTUAL PROPERTY

All content, features, and functionality of VivaLingua are owned by Sevenfires AI LLC and protected by applicable intellectual property laws.

14. TERMINATION

We reserve the right to suspend or terminate your account at any time for violations of these Terms, with or without notice.

15. GOVERNING LAW

These Terms shall be governed by the laws of the State of Wisconsin, United States, without regard to conflict of law provisions.
